These terms govern your use of our website and your purchase of our products. By browsing our store or placing an order, you agree to them.

This website, including its pages, products, and services, is operated by Legendary Branding, LLC ("Legendary Branding," "we," "us," or "our"). These Terms of Service ("Terms") are a legal agreement between you and us that governs your access to this site and any purchase you make through it.

Please read these Terms before using our site or placing an order. If you have questions, our contact details are in Section 18.

2. Acceptance and Related Policies

By accessing or using legendary-branding.com, creating an account, or completing a purchase, you confirm that you have read, understood, and agree to these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, all of which are part of this agreement.

If you do not agree, please do not use our website or purchase our products.

3. Eligibility

You must be at least 18 years old to make purchases. If you are under 18, you may use the site only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

By using this site, you confirm that you meet this requirement and that the information you provide is accurate, complete, and current.

4. Products and Production

We work to display our products accurately, including descriptions, images, measurements, and materials. We do not warrant that product descriptions, images, or other content are error-free, complete, or current.

Our products are produced through print-on-demand manufacturing and fulfillment partners. Colors may look different on your screen than in person, and small variations in print placement, color, and finish can occur between production runs. These normal variations are not defects.

We may limit quantities, discontinue products, and correct or update descriptions at any time without notice.

5. Pricing, Taxes and Payment

All prices are in US Dollars (USD) unless stated otherwise and may change without notice. Applicable sales taxes and, for international orders where applicable, import duties and taxes are calculated and added at checkout and shown before you pay. They are not included in the listed product price.

We accept major credit and debit cards and digital wallets such as Shop Pay, Apple Pay, and PayPal. The payment options available to you are shown at checkout. Payments are processed through Shopify's secure, PCI-compliant checkout, and we do not store your full payment details on our servers.

Discount codes and promotions are subject to their stated terms, may not be combined unless stated, and may be changed or withdrawn at any time.

If a product is listed at an incorrect price because of a typographical or system error, we may cancel or refuse any order placed at that price and will notify you promptly.

6. Orders and Cancellations

Your order is an offer to purchase. We may accept or decline any order for reasons including product availability, suspected fraud, pricing or product-information errors, or failure to meet these Terms.

Because items are produced to fulfill orders, production can begin soon after payment. To request a cancellation, email lb@legendary-branding.com as soon as possible. We cannot guarantee cancellation once an order has entered processing or production, and in that case our return policy applies.

If we cancel an order for any reason, we will notify you and refund the full amount to your original payment method promptly.

7. Shipping and Delivery

We ship worldwide to supported destinations. Standard shipping is $5 on orders under $100 and free on orders of $100 or more. Express shipping is $12. Availability and final charges are confirmed at checkout.

Orders are typically processed within 1–3 business days and produced in about 2 business days. Estimated shipping time after that is 5–7 business days within the US and 7–20 business days internationally, depending on the destination. Details are in our Shipping Policy.

Delivery times are estimates, not guarantees. We are not liable for delays caused by carriers, customs processing, weather, or other circumstances outside our control. You are responsible for providing a complete and accurate delivery address; we are not responsible for orders delivered to an incorrect address you provided.

For international orders, where applicable to your destination, import duties and taxes are calculated and added at checkout and shown before you pay. If a carrier or customs authority requests an unexpected payment, please contact us before paying so we can investigate.

8. Returns, Refunds and Exchanges

You may request a return within 30 days of delivery for items that are unworn, unwashed, and in original condition. To start a return, email lb@legendary-branding.com with your order number. Please do not send items back without approval.

For change-of-mind or sizing returns, return shipping costs are the customer's responsibility and may be deducted from your refund. If your item arrives damaged, defective, or incorrect, contact us within 30 days of delivery with your order number and photos, and we will provide a replacement, exchange, or full refund and cover return shipping.

Approved refunds are issued to your original payment method within 5–7 business days after we receive and approve your return; your bank may take additional time to post the credit. Gift cards, digital products, and items marked Final Sale are not returnable unless they arrive damaged, defective, or incorrect. Full details are in our Return & Refund Policy.

9. Intellectual Property

All content on this website, including logos, trademarks, product designs, graphics, photography, copy, and brand elements, is owned by Legendary Branding, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, create derivative works from, or otherwise use this content without our prior written permission. Personal, non-commercial use of the site for browsing and shopping is permitted.

10. Acceptable Use

When using our website, you agree not to:

Use the site for any unlawful purpose or in violation of any applicable law or regulation
Attempt to gain unauthorized access to the site, our systems, or other users' accounts
Send unsolicited advertising or spam
Interfere with other users' use of the site or engage in conduct that may expose us or our users to harm
Scrape or collect data from the site by automated means without our written consent
Impersonate Legendary Branding or its staff, or use our name, logo, or trademarks in a way that suggests affiliation or endorsement without our written permission

We may restrict or terminate access for anyone who violates these Terms.

11. Third-Party Services

Our website and fulfillment rely on third parties, including payment processors, print-on-demand and fulfillment partners, shipping carriers, and social media platforms, and may link to third-party sites. We do not control these third parties and are not responsible for their content, practices, or terms. Using a third-party site is at your own risk, and we encourage you to review its terms and privacy policy.

12. Disclaimer of Warranties

To the fullest extent permitted by law, this website and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted or error-free, or that it is free of harmful components. Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.

13. Limitation of Liability

To the fullest extent permitted by law, Legendary Branding, LLC and its owners, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or business interruption, arising out of or related to your use of, or inability to use, our website or products.

Our total liability for any claim related to these Terms or your purchase will not exceed the amount you paid for the specific order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Legendary Branding, LLC and its owners, officers, employees, and agents from claims, losses, damages, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your violation of any third-party right, or your misuse of our website or products.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.

Before starting a formal dispute, please contact us at lb@legendary-branding.com. We will make a good-faith effort to resolve your concern within 30 days.

If informal resolution fails, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Cook County, Illinois, and, to the extent permitted by law, only on an individual basis, not as a class action. Either party may bring an individual claim in small claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction.

16. General Provisions

These Terms, with the policies referenced in Section 2, are the entire agreement between you and us about your use of the site and your purchases. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a sale or reorganization of our business.

17. Changes to These Terms

We may update these Terms at any time and will change the "Last updated" date at the top when we do. For material changes, we will make reasonable efforts to notify you, such as by email or a notice on our website.

Changes apply to orders placed after they take effect. Continued use of the site after changes take effect means you accept the updated Terms.
